Cop (24) gets 15 years for raping suspect in holding cells

Misheck Muchena a Bulawayo policeman has been slapped with a 15 year jail sentence for raping a suspect in police holding cells after promising release her and destroy her case docket.

Muchena, 24, pleaded not guilty but was convicted by Bulawayo magistrate Owen Tagu for the 2010 attack. The court heard that the attack took place sometime in August 2010 after the woman had been arrested and detained over-night at Nkulumane Police Station in case involving malicious damage to property.

Prosecutor Admire Chikwayo said Muchena sneaked into the woman’s holding cell and gave her two blankets which he had taken from male suspects also detained at the police station. He then offered to release her and destroy the case docket but the woman said she had no money to pay him. Muchena then left the cell but returned a few minutes later and forced himself on her once.

The court heard that he was to return again later during the night and rape the suspect twice but forgot his mobile in the room as he left. The woman later reported the attack leading to Muchena’s arrest.

Asked in court why his mobile was in the room, Muchena said the woman had asked to use it in order to phone her husband and ask him to visit her. The woman however, denied ever requesting to use the phone.

The rapist cop will serve ten years after the magistrate suspended five saying he had considered the fact that Muchena had since lost his job because of the case.

Boy Attempts To Rape 34 Year Old, Testicles Gets Crushed

A 17-year-old boy who attempted to rape a 34-year-old woman in a secluded footpath has been arraigned before the courts.

The boy, whose name has been withheld due to his age, has been remanded in the custody of his mother.

The court heard that on June 7 this year, the woman was walking along a footpath from a granary to Kuwadzana 7 enroute to church.

When the woman passed the teenager, who was walking on the opposite side, she was startled when he pounced on her. The boy allegedly grabbed her by the neck and choked her.

It is the State’s case that the minor pressed the woman’s eyes with one hand while trying to remove her underwear with the other.

Prosecutor Junior Mugebe said the boy tripped the woman but they continued to wrestle each other.

Allegations are that during the scuffle, the boy scratched the woman’s private parts, before the woman squeezed his testicles until he let her go.

The minor then ran away but was apprehended by people in a nearby field who heard the cries of the woman.

Magistrate Tendai Mahwe remanded the minor to June 24.

Man Fall asleep whilst raping woman, gets caught!

AN alleged rapist reportedly tied his victim, raped her four times before falling asleep, giving the complainant enough time to escape and inform neighbours.

Inyathi villagers then teamed up and arrested the assailant who had allegedly raped the 29-year-old woman last December.

This came to light yesterday when the alleged rapist, Brian Dube (32) of Siganda area, Inyathi, appeared before Bulawayo magistrate Chrispen Mberewere facing four counts of rape.

Dube is being charged with rape as defined by Section 131 of the Criminal Law (Codification and Reform) Act Chapter 9:23.
Prosecutor Marlvin Nzombe for the State told the court that on December 30 last year, the complainant retired to bed with her two sons aged seven and three.

“She did not lock or bolt the door from inside. During the night, the accused got to the complainant’s homestead and pushed the bedroom door open to gain entry. While inside, he went to the bed where the complainant was sleeping, pressed her on the ground and while holding her tight by the neck, he then threatened to kill her and tied both her hands with his shirt. He also tied her on to the bed and stuffed a piece of cloth in her mouth to stiffle her screams,” he said.

Nzombe said the accused then allegedly tore the complainant’s underwear and raped her four times in succession.

“After the fourth time, the accused fell into deep sleep giving an opportunity to the complainant to untie herself. She then ran to inform her neighbours who teamed up and proceeded to her homestead where they found the accused still in deep sleep and arrested him,” he said.

Nzombe said the complainant made a report at a police station the next day and the villagers then handed the alleged rapist over to the cops.

“On January 2 the complainant was examined by a doctor who issued a medical report which can be produced in court as an exhibit,” he said.

Mberewere remanded Dube in custody to May 19 for trial.
